Transitional arrangements for the implementation of the CLP Regulation in the EU

CLP will be implemented in two stages:

  1. for substances requiring re-classification according to CLP
  2. after completion of the re-classification of substances – will begin the procedure re-classification of mixtures
  3. until 1 December 2010, substances are classified, labeled and packaged in accordance with Directive 67/548/EEC
  4. until 1 June 2015, mixtures are classified, labeled and packaged in accordance with Directive 1999/45/EC
  5. from 1 December 2010 until 1 June 2015, substances are classified in accordance with Directive 67/548/EEC and CLP. They are labelled and packaged in accordance with CLP

From 1 June 2015 and to substances and preparations shall be governed solely by the CLP

Transitional provisions

Before 1 June 2015, the mixture may be classified, labeled and packaged in accordance with CLP. In such cases, do not apply the provisions of Directive 1999/45 /EC concerning the labeling and packaging. In this case:

  • put in the SDS double classification: according to directives 67/548/EEC, 1999/45/EC and CLP
  • on the package, instead of marking according to current rules, place a label according to CLP
  • apply the rules on packaging contained in the CLP
  1. Substances that are classified, labeled and packaged in accordance with Directive 67/548/EEC and has already been introduced on the market before 1 December 2010 to 1 December 2012 need not be re-labeled and packaged in accordance with this Regulation
  2. Mixtures that are classified, labeled and packaged in accordance with Directive 1999/45/EC and has already been introduced to the market before 1 June 2015 to June 1, 2017 need not be re-labeled and packaged in accordance with this Regulation

Introduction to marketing – paid or unpaid means supplying or making available to third parties. Import shall be deemed to be placing on the market.
